Under Operation Arctic Frost, the FBI conducted toll-record and movement analysis on Rep. Mike Kelly and Sen. Scott Perry, mapping their communications during post-election investigative activity. These searches were authorized without particularized criminal predication and were aimed at lawmakers’ efforts to question Pennsylvania’s certification and support election-related litigation. This surveillance, concealed via nondisclosure orders, functioned as a coercive response to legislative inquiry rather than a neutral criminal probe.

The Arctic Frost investigation was opened Apr. 2022 and transferred to Special Counsel Jack Smith in Nov. 2022. It involved at minimum 197 subpoenas targeting 430+ Republican-aligned individuals including toll-record collection for at least 8 senators and multiple representatives under non-disclosure orders.
