Attack Vector 8: Seditious Conspiracy
Election Day Conspiracy
Election Day examines conspiratorial conduct occurring on or directly incident to November 3, 2020, that potentially implicates the broader seditious conspiracy theory of the case. Specifically: the coordinated exclusion of lawful observers, the deployment of uncredentialed partisan operatives inside counting facilities, the operational control of election infrastructure by private actors, the physical obstruction of challengers, and the exploitation of Election Day procedural vulnerabilities in a manner consistent with pre-election planning objectives. The alignment between pre-election war-gaming scenarios — which modeled preventing Republican challenges — and the documented Election Day conduct is itself circumstantial evidence of coordinated intent under 18 U.S.C. § 2384.
