Case Dismissals

Case dismissal decisions are gatekeeping choices that determine whether election‑related claims proceed to discovery and evidentiary hearing or are terminated on the pleadings. The investigative record shows that in multiple states, a large share of post‑2020 election cases were dismissed on standing, mootness, or laches grounds, often before plaintiffs were permitted to obtain or present key evidence such as network logs, chain‑of‑custody records, or detailed audit findings.

This subsection examines the pattern and timing of these dismissals, including cases where courts acknowledged partial factual support (e.g., limited connectivity or documentation gaps) yet declined to authorize discovery, as well as the frequent public mischaracterization of these outcomes as dismissals “for lack of evidence.”
