Delaware County Evidence Destruction – Named Witness Account of Physical Record Burning (PA)

[Established Fact – RTKL deficiencies confirmed; Miller testimony is named-witness sworn allegation] On or about May-June 2021, Delaware County Director of Elections James Allen directed the removal and destruction of November 3, 2020 election materials. A named witness, Regina Miller, states she witnessed Attorney Thomas Gallagher and James Ziegelhoffer physically tear election data into pieces, stating they would “have a campfire to burn the data.” Ziegelhoffer justified the destruction by stating the data had “no audit value” because it “wouldn’t match the election results” – a statement that, if accurate, constitutes an explicit admission that the physical record did not match the certified results. The destruction occurred after a Right to Know Law request had been filed on May 21, 2021, consistent with consciousness of guilt and potentially satisfying the “in contemplation of a proceeding” element of 18 U.S.C. ยง 1519.
