Lawfare Waged Against President Trump (US)

Disputed Fact

No person in American history has faced a more comprehensive, simultaneous array of criminal indictments, civil suits, congressional proceedings, and institutional actions than Donald Trump in the years following the 2020 election. Trump and his supporters have consistently characterized these legal actions as coordinated political warfare — “lawfare” — deployed by opponents who failed to defeat him electorally. Critics counter that the actions represent legitimate legal accountability. The documented record is vast and unprecedented in scale. 

SECOND IMPEACHMENT — INCITEMENT OF INSURRECTION (January 2021)

On January 13, 2021 — just seven days before the end of his first term — the House of Representatives voted 232–197 to impeach Trump on a single article: “incitement of insurrection” related to January 6, making him the first U.S. president ever impeached twice. Ten Republicans joined all Democrats.

FEDERAL INDICTMENT — ELECTION INTERFERENCE (D.C.) — JACK SMITH (August 2023)

On August 1, 2023, Special Counsel Jack Smith secured a 4-count federal indictment against Trump in U.S. District Court for the District of Columbia — the most consequential of all the prosecutions:

  • Count 1: Conspiracy to defraud the United States (18 U.S.C. § 371)

  • Count 2: Conspiracy to obstruct the certification of the Electoral College vote on January 6, 2021

  • Count 3: Obstruction and attempt to obstruct the official proceeding

  • Count 4: Conspiracy against rights — conspiring to deprive citizens of the right to vote and have votes counted

Smith issued a superseding indictment on August 27, 2024, narrowed to comply with the Supreme Court’s immunity ruling in Trump v. United States (July 1, 2024). Following Trump’s re-election, Smith moved to dismiss the case on November 25, 2024, citing DOJ policy prohibiting prosecution of a sitting president. Judge Tanya Chutkan dismissed the case without prejudice on November 25, 2024.

GEORGIA RICO INDICTMENT — 13 CRIMINAL CHARGES (August 2023)

On August 14, 2023, Fulton County District Attorney Fani Willis secured a 41-count RICO indictment against 19 defendants, including Trump, who faced 13 individual charges. The alleged conspiracy centered on efforts to overturn Georgia’s 2020 election results, including Trump’s January 2, 2021 phone call pressuring Secretary of State Brad Raffensperger to “find 11,780 votes.”

The case was severely weakened after revelations that DA Willis had a romantic relationship with her specially appointed prosecutor Nathan Wade. Judge Scott McAfee allowed Willis to continue only after Wade resigned, but the case was further derailed by appeals and Trump’s re-election.

NEW YORK CRIMINAL CONVICTION — 34 FELONY COUNTS (May 2024)

On May 30, 2024, a Manhattan jury found Trump guilty on all 34 counts of falsifying business records in the first degree — making him the first U.S. president ever convicted of felony charges. The case, prosecuted by Manhattan DA Alvin Bragg, alleged Trump concealed hush money payments to adult film actress Stormy Daniels to influence the 2016 election.

NEW YORK CIVIL FRAUD — $464 MILLION JUDGMENT (February 2024)

In February 2024, New York State Supreme Court Judge Arthur Engoron ordered Trump and his co-defendants to pay $363.8 million in disgorgement, plus pre-judgment interest — totaling over $464 million — in a civil fraud case brought by AG Letitia James. The court also banned Trump from serving as an officer or director of any New York corporation for three years.

However, in August 2025, a divided five-justice appellate panel vacated the entire $464.6 million disgorgement award, ruling it violated the Eighth Amendment’s prohibition on excessive fines — a major victory for Trump. The court remained divided on the underlying fraud liability, with no clear majority opinion.

 E. JEAN CARROLL — $83.3 MILLION DEFAMATION JUDGMENT (2024–2025)

In January 2024, a federal jury ordered Trump to pay $83.3 million to columnist E. Jean Carroll for defaming her after she publicly accused him of sexual assault in the mid-1990s. Of that amount, $65 million was designated as punitive damages after the jury found Trump acted with malice.

In September 2025, the 2nd U.S. Circuit Court of Appeals upheld the full $83.3 million judgment, rejecting Trump’s presidential immunity arguments and finding “ample evidence” of malice. In May 2026, the appeals court agreed to let Trump delay payment while the Supreme Court considers an appeal, provided he posts a $7.4 million bond.

FEDERAL CLASSIFIED DOCUMENTS INDICTMENT — JACK SMITH (June–July 2023)

In June and July 2023, Jack Smith obtained a 40-count federal indictment against Trump related to his retention of classified documents at Mar-a-Lago after leaving office. The case was assigned to U.S. District Judge Aileen Cannon, who was ultimately removed by the 11th Circuit for improper rulings. The case was dismissed after Trump’s re-election, consistent with DOJ policy on sitting presidents.

President Trump has consistently characterized all of these actions as “the greatest witch hunt in the history of our country” and politically motivated lawfare. He has since returned to office, directed the DOJ to investigate prosecutors who brought charges against him, and has been partially vindicated on the civil fraud case. The $83.3 million Carroll judgment and the New York felony conviction remain the only final, upheld outcomes. Both federal criminal cases and the Georgia RICO case were all ultimately dismissed — each without reaching a jury trial.
