[Disputed Fact – As to whether individual signatories knew the characterization was false at time of signing] Fifty-one former senior intelligence officials signed and published, in October 2020, a letter stating that the Hunter Biden laptop story bore “the hallmarks of Russian disinformation.” This letter was published ten days before the 2020 presidential election and was used by social media platforms – specifically Twitter, which blocked sharing of the New York Post story – and media organizations to justify suppression or non-coverage of a story directly relevant to the presidential election. The Intelligence Community Inspector General subsequently found that the laptop was authentic and that the Russian disinformation characterization was inaccurate. Former CIA Deputy Director Michael Morell testified before the Senate Judiciary Committee that the letter was coordinated with the Biden campaign – specifically that Biden campaign official Antony Blinken contacted Morell about organizing it. If the coordination with a political campaign is established, the signatories – former government officials using their government credentials as the explicit basis for their authority – may have made an in-kind contribution to the Biden campaign in violation of 52 U.S.C. § 30118, and may have violated 18 U.S.C. § 595 (interference with a federal election by employees of a federally funded program, applicable to officials receiving government pensions or security clearances funded by federal appropriations).
