The Election Integrity Partnership actively mitigated and labeled social media content reporting on the discovery of absentee ballots that had been found dumped in a ditch in Greenville, Wisconsin. The event was a confirmed, documented occurrence – it was investigated by local law enforcement. It was not a false claim, a fabricated story, or foreign disinformation. The EIP targeted the content not because the underlying fact was false, but because the factual reporting on a real event “fueled broader domestic ‘mail-in voter fraud’ narratives that the EIP deemed detrimental to election integrity.” This is a categorical distinction of profound constitutional significance: the suppression of factually accurate reporting on a real, police-investigated event, on the grounds that accurate information about that event contributes to a political narrative the government disfavors, is precisely the form of viewpoint-based censorship that the First Amendment was designed to prohibit. The government may not suppress true information because it is politically inconvenient. United States v. Alvarez, 567 U.S. 709 (2012). The documented suppression of the Greenville ballot dumping reports represents the clearest concrete example of the EIP apparatus being deployed not to combat misinformation but to protect a government-preferred narrative against accurate factual challenge.
