DNI Ratcliffe Memorandum: CIA Analysts Suppressed Chinese Election Interference Assessments on Explicit Political Grounds – Violation of IRTPA Analytic Standard B (China)

On January 7, 2021, Director of National Intelligence John Ratcliffe issued a formal memorandum documenting a significant intelligence failure: career CIA analysts had suppressed evidence of Chinese interference in the 2020 election on explicit political grounds. Ratcliffe’s memorandum stated that “China analysts were hesitant to assess Chinese actions as ‘undue influence’ or ‘interference.’ These analysts appeared reluctant to have their analysis on China brought forward because they tend to disagree with the administration’s policies.” Ratcliffe characterized this as a violation of Analytic Standard B – Independence of Political Considerations under IRTPA § 1019. The substance of the suppressed assessments – what specifically the CIA found regarding Chinese interference with election infrastructure – has never been publicly disclosed and represents the most significant evidentiary gap in the foreign interference record. The EO 13848 45-day post-election assessment – required to be delivered by approximately December 18, 2020 – was not publicly issued in a form that addressed the suppressed China analysis. Whether the suppression also violates 18 U.S.C. § 1001 (false statements), 18 U.S.C. § 1505 (obstruction), or the Inspector General Act, 50 U.S.C. § 3033 depends on the specific content of the suppressed assessments and what representations were made to oversight bodies – a determination requiring IG investigation and potential declassification.
