Non-Certified Software Tools, Pre-Election EMS Changes, and Failed L&A Tests on Certified Dominion System (PA)

Disputed Fact

Independent forensic examination of Fulton County’s Dominion Democracy Suite 5.5 server – conducted by a third-party consultant retained by Fulton County – found: (a) failure to meet Commonwealth certification requirements; (b) non-certified database tools installed on the Dominion system; (c) changes made to the EMS three weeks before the 2020 election; and (d) failure to conduct required Logic and Accuracy (L&A) inspections. These findings collectively establish that Fulton County’s deployed Dominion system materially deviated from its certified configuration in multiple independent respects simultaneously. The Pennsylvania Department of State subsequently decertified Fulton County’s machines – not because of the substantive violations found by the audit, but because Fulton County had hired an independent third-party to conduct the examination, which the Secretary characterized as grounds for decertification. Fulton County sued, characterizing the decertification as unlawful retaliation.

NOTE: Disputed fact is whether or not SQL Server Management Studio is a component of the EAC certified configuration as it is not explicitly listed as a component by the EAC.
