Disputed Fact
System log files reviewed during post-election forensic analysis indicate that Maricopa County’s tabulation software was surreptitiously altered in components that control how ballots are read – the core functional module of any optical scan tabulator. This alteration rendered the deployed software an uncertified build not matching the EAC-approved Dominion Democracy Suite 5.5B golden image. Compounding this configuration failure, statutorily mandated pre-election Logic and Accuracy (L&A) testing was not conducted on all vote center tabulators as required; instead, testing was conducted only on five spare tabulators. L&A testing on machines that were not the machines used on Election Day cannot validate the Election Day configuration. Maricopa County operated over 230 vote centers on November 3, 2020.
