The Wisconsin Elections Commission (WEC) failed to record in WisVote available ineligibility information regarding: (1) persons under court-ordered guardianship who are prohibited from voting under Wis. Stat. § 6.03(1)(a); (2) non-citizens who are ineligible under Wis. Stat. § 6.02; and (3) adjudicated incompetent individuals. Circuit court guardianship data was available to WEC but was not integrated into WisVote. Department of Transportation records identifying non-citizen driver’s license holders were available but not cross-referenced. Both failures violate the HAVA requirement, 52 U.S.C. § 20503(b), that states remove ineligible voters from their computerized voter lists in accordance with state law.
