Director Baxter’s Denial Under Oath – Knowingly False Official Statement at Certification

[Disputed Fact – As to whether knowing or truthful] During the November 23, 2020 State Board of Canvassers certification meeting, State Board member Norman Shinkle directly asked Detroit Department of Elections Director Daniel Baxter whether he had provided revised poll lists to the Wayne County Board of Canvassers. Baxter answered: “No. I’m not aware of that.” This denial appears to be in direct conflict with Bureau of Elections Director Brater’s documented direction to Palmer to contact Baxter for the “unlisted list,” and with the delivery of the black trunk. If the denial was knowingly false – as Baxter’s own colleagues’ actions suggest it was – it constitutes false testimony at a quasi-judicial proceeding and potential perjury exposure under MCL § 750.423 and false statement liability under 18 U.S.C. § 1001.
