Unlawful Post-Election Poll Book Replacement – “Black Trunk” Delivery 13 Days After Election Night (MI)

[Disputed Fact – Origin and lawfulness of revised poll books uninvestigated] In the immediate aftermath of the November 3, 2020 election, 71% of Detroit’s Absentee Voter Counting Board precincts were mathematically unbalanced – meaning the poll book count of check-in voters did not match the number of ballots scanned, with some precincts reporting discrepancies of up to 600 votes. This figure represents more out-of-balance precincts than all other 82 Michigan counties combined. On November 16, 2020 – thirteen days after the election – Bureau of Elections Director Jonathan Brater directed Wayne County Canvasser Monica Palmer to contact Detroit’s Department of Elections Director Daniel Baxter about an “unlisted list.” Subsequently, a “black trunk” was delivered to the Board of Canvassers containing “new revised” poll books that retroactively balanced the AVCB precincts to a maximum discrepancy of 29. The original, unbalanced poll books were effectively replaced by new documentation of unknown origin and chain of custody, delivered days before the November 17 certification meeting. Per MCL 168.813, all voter history data for a given election must be uploaded to the Michigan Qualified Voter File (QVF) within 7 days of the election.
