Commingled Original and Duplicate Ballots – Batch Manifests Do Not Match Physical Contents; UOCAVA Double-Counts (AZ)

Established Fact

Post-election audit confirmed that boxes of ballots delivered to auditors contained commingled original damaged ballots and their machine duplicates, inconsistently identified, with batch manifests that did not match physical contents. In the documented example of Box EVH1/11-07/MC17349, the manifest listed 14 batches of original ballots while the box physically contained 7 original and 8 duplicate batches, with one batch missing from the manifest entirely. Additionally, instances were identified where electronic UOCAVA (uniformed and overseas citizen) ballots were duplicated and counted more than once. The Arizona 2019 Election Procedures Manual requires segregation of originals and duplicates; the Secretary of State’s own counsel represented to the Arizona Supreme Court in CV2020-015285 that duplicated ballots were “segregated and preserved” – a representation directly contradicted by the physical audit record.
