WEC Certification Incorporated Votes Cast Under Unlawful Procedures – Drop Boxes, Nursing Home Absentee Violations, and “Indefinitely Confined” Abuse (WI)

[Established Fact – As to subsequent court rulings] The Wisconsin 2020 presidential election certification incorporated votes cast under at least four categories of procedures subsequently found unlawful: (1) absentee ballot drop boxes, ruled illegal by Waukesha County Circuit Court in Teigen v. WEC (affirmed, 2022 WI 64); (2) absentee ballots collected from nursing home residents without Special Voting Deputies (SVDs) as required by Wis. Stat. § 6.875, producing documented 100% turnout rates among residents in cognitive-impairment facilities; (3) 220,404 “indefinitely confined” ballots cast by voters who did not meet the statutory eligibility criteria under Wis. Stat. § 6.86(2), following instructions from partisan county clerks advising any voter to claim that status; and (4) ballots cast by wards under guardianship who were legally ineligible under Wis. Stat. § 6.03(1)(a). WEC’s certification did not note, qualify, or flag any of these categories. WEC Chairperson Jacobs certified results that incorporated votes cast through mechanisms that a court of competent jurisdiction later determined were illegal – a certification based on procedures whose legality was at minimum unresolved at the time of certification.
