440,781 “Unknown” Mail Ballots and 155,053 Voter Deficit – No Recount Could Resolve the Foundational Discrepancy (PA)

Established Fact

The Public Interest Legal Foundation (PILF), analyzing EAC post-election survey data, documented that 440,781 Pennsylvania mail ballots were classified as “unknown” – meaning election officials had no record of what happened to them. This figure exceeded the certified presidential margin of victory (81,660) by a ratio of more than 5:1. Separately, Representative Francis Ryan’s December 2020 report identified that Secretary Boockvar certified 6,915,283 votes for presidential candidates against only 6,760,230 voters recorded in the SURE system as having voted – a deficit of 155,053 votes over voters. No recount mechanism was triggered or designed to reconcile this voter-to-vote discrepancy. Pennsylvania’s recount statutes govern the manual re-tallying of ballots; they do not require reconciliation of the SURE system voter record against certified totals. This structural gap means that a recount, even if perfectly conducted, would have re-tallied the same inflated ballot total without examining whether those ballots corresponded to actual voter participation records. The recount process was thus structurally incapable of detecting or correcting the most significant documented discrepancy in Pennsylvania’s results.
