Certification Over Known Material Audit Defects – Uncertified Tabulator Returns and False Batch Tallies (GA)

Established Fact

Georgia Governor Brian Kemp certified the presidential election result with a margin of 12,670 votes despite the following known, unresolved conditions at the time of certification: (a) Fulton County’s hand-count audit contained 6,691 fictitious votes (5,618 for Biden, 1,025 for Trump) as identified by the Governor’s own referral in SEB2021-181; (b) 148 advance voting tabulator official returns in Fulton County were never certified, representing approximately 316,000-320,000 ballots, a defect Fulton County later conceded before the SEB; (c) Logic Accuracy testing had not been completed on advance voting equipment; and (d) the Georgia Senate Subcommittee had publicly issued its non-certification finding. Certification over these known conditions transmitted a facially defective state electoral result to Congress as a valid basis for the national certification.
