On January 6, 2021, Secretary of State Brad Raffensperger transmitted a ten-page letter to Congress and Vice President Pence representing that no fraud or irregularities occurred in Georgia. The letter was not made public for several months after its transmission. A subsequent analysis by VoterGA identified what researchers characterized as 42 false or misleading statements within the letter. Critically, the letter omitted: (a) the Georgia Senate Subcommittee on Elections’ December 17, 2020, conclusion that the election was “so compromised by systemic irregularities and voter fraud that it should not be certified”; (b) the Governor’s referral of 6,691 fictitious ballots to the State Election Board (SEB2021-181); (c) the Secretary’s own December 22, 2020 press release acknowledging over 250 open election investigations – just 15 days before the Congressional letter claimed no fraud had occurred; and (d) the fact that 148 advance voting tabulator returns in Fulton County had never been certified, as Fulton County later conceded in SEB2022-015. Congress was presented with an affirmative representation of election integrity while each of these material facts was contemporaneously known to the transmitting official.
