Intentional Record Destruction – Delaware County Certified with 244 of 428 Precincts Missing Required Documentation

[Disputed Fact – Record destruction – named-witness testimony, not yet adjudicated] Delaware County certified the November 3, 2020 election on or about November 24, 2020, contributing data to Secretary Boockvar’s statewide certification. Delaware County’s own Right to Know Law (RTKL) response, dated June 28, 2021, established that: 15 precincts had no Return Sheets at all; 16 precincts had blank Return Sheets; and 213 precincts were missing required information on their Return Sheets – totaling 244 of 428 precincts (more than half) with missing or incomplete documentation legally required for certification. Additionally, Delaware County was missing: 125 of 428 tally tapes for Scanner 1; 137 of 428 ballot-count tapes for Scanner 1; 255 of 428 open-poll tapes; and 233 of 428 zero-report tapes – the machine-generated records establishing that machines registered zero before counting began. The absence of zero-report tapes means there is no documentary basis to confirm that machines were not pre-loaded with votes before the election began. Named witness Regina Miller states she subsequently witnessed individuals physically tear election data and place it in the trash, with one official stating the data “had no audit value because it wouldn’t match the election results” – an admission, if true, that the physical record did not match what was certified.
