Fulton County conceded in SEB2022-015 proceedings that all 148 advance voting tabulator official returns representing approximately 316,000-320,000 ballots were never formally certified by the county canvassing authority prior to the county submitting those results to the Secretary of State for statewide certification. The State Election Board voted to refer this matter to the Georgia Attorney General. The certification of a statewide election on the basis of county returns that themselves incorporated uncertified tabulator data violates the foundational requirement of O.C.G.A. ยง21-2-498 that returns be certified before they form the basis for statewide certification. The 316,000-ballot figure is more than 25 times the certified margin of victory. Additionally, the EOG Report documented that only 9 zero tapes existed for the 148 advance voting tabulators, and that all 138 closing tapes for those tabulators were fraudulent, invalid, and did not bear the serial numbers of the machines actually used.
