[Disputed Fact – As to intent and whether destruction was authorized] Named witness Regina Miller testified that she personally observed Delaware County official Thomas Gallagher and county employee James Ziegelhoffer physically tear election data – including machine tapes and return sheets – into pieces and place them in the trash. Ziegelhoffer was reported to have justified the destruction by stating the data had “no audit value” because it “wouldn’t match the election results.” If this statement was made as reported, it constitutes an admission that the physical record did not match the certified result – which would independently establish fraudulent certification. On May 27, 2021, plaintiff Gregory Stenstrom alleges that newly appointed Director James Allen directed the removal and destruction of additional November 3, 2020 election evidence. Internal county emails from May 4, 2021 (Perrone to Winterbottom/Iacono/Allen) confirm that “everything with the last election was screwed up,” specifically referencing machine-sliced ballots and chain-of-custody failures. Additionally, 27 banker boxes of blank official ballots were found in the Delaware County Bureau of Elections in July 2021 with no chain-of-custody documentation.
